Terms and Conditions
To qualify for grant aid under this Scheme the following terms and conditions must be met in all cases. Applicants should please note that these terms and conditions will apply to all applications. Applications that fail to comply with these terms and conditions will be deemed ineligible and will not be considered further.
1. The onus of eligibility lies with the applicant, i.e. the applicant must ensure and demonstrate that it qualifies under the Interim Remediation Scheme of Fire Safety Defects in Eligible Apartments and Duplexes 2023 (“the Interim Remediation Scheme”) that has been introduced to support the remediation of apartments and duplexes with fire safety defects.
2. The Housing Agency and the Owners’ Management Company must formalise a grant agreement. This agreement defines the terms and conditions governing the award of the grant.
3. The Interim Remediation Scheme is available to such Multi-Unit Developments captured by the Multi-Unit Developments Act 2011 (as amended and altered) (“the Act”).
4. The applicant will demonstrate its legal identity to the satisfaction of The Housing Agency.
5. The applicant must have ownership of the common areas of the development as defined in the Act.
6. Acknowledgement of an application does not constitute any form of entitlement to any form of grant aid whatsoever and neither should the applicant constitute any assistance given by the officers of The Housing Agency as a form of indication that grant aid will become available.
7. The Housing Agency will determine the eligibility of applications. Applications that fail to provide mandatory information, and applications that do not meet all the mandatory criteria, will be deemed ineligible.
8. As the application will be made through the online portal, The Housing Agency does not require a hard copy of the application.
9. Eligibility for inclusion to the Interim Remediation Scheme does not imply inclusion in the Full Remediation Scheme.

Freedom of Information
The Housing Agency and The Department of Housing, Local Government and Heritage are subject to the provisions of the Freedom of Information (FOI) Act 2014. By supplying information or records to The Housing Agency you acknowledge and agree that The Housing Agency and the Department may be required to disclose or release some or all of this information/records in response to an FOI Act request received by them.
The Housing Agency and the Department shall not be responsible to you for any loss or damage (including inter alia reputational damage) that may arise for you or any third party from such disclosure or release. The Housing Agency may, at its sole discretion and in exercise of its obligations under the FOI Act, contact you prior to it responding to an FOI Act request, where information/records provided by you may come within the scope of the request. If The Housing Agency does contact you in this regard, it will consider any submissions you may make as to why such information/records should not be disclosed or released. However, irrespective of your position, The Housing Agency will make the final decision as to whether or not it is required to disclose or release the relevant information/records under the FOI Act. If you do not accept this position, you should not submit an application form, or you should in advance of submission redact information/records to remove material you do not wish to have disclosed or released. Please note that redacting material may limit its usefulness to the application process.
